(3) This section shall not apply to any existing domestic building, the ground surface of which has been paved to the satisfaction of the Building Authority in accordance with any existing law or by-law and which is so maintained.

Where the ground surface of any building or the Repairs to floor of any kitchen, bathroom, latrine, or water closet, or impermeable the ground surface of any area, backyard, court-yard, alley- over ground way or space on which slops may be thrown or from which surface. foul waters flow, is or has been paved or covered over with [ef. s. 167.] impervious material, and such material has been subsequently broken, excavated or otherwise disturbed, or has perished, the landlord or owner shall make good the same to the satisfaction of the Building Authority upon the completion of any work for the execution of which the same has been broken or other- wise disturbed or within fourteen days from the receipt by him of written notice from the Building Authority so to do; and in default thereof he shall be liable to a fine not exceeding twenty-five dollars for each offence, and to a further fine not exceeding ten dollars for each day after such conviction during which such offence continues.

35. When any opening in a timber floor is to be filled in, every joist over such opening shall be formed in one length to span from wall to wall unless otherwise approved by the Building Authority.
